Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Bynder B.V. (“Bynder AI”). By creating an account, purchasing credits or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

You must be at least 16 years old and able to enter a binding contract. You are responsible for:

• The accuracy of the information you provide.
• Keeping your password confidential (minimum 8 characters).
• All activity that occurs under your account.

Bynder AI is sold as prepaid credits. One credit = €0.10 (base currency). USD, GBP and PLN are billed at the mid-market exchange rate shown at checkout. Minimum purchase is 50 credits. Credits are consumed as you use platform features (prospect enrichment, message generation, sends, meetings booked, etc.).

• There are no subscriptions, free trials or demo tiers.
• Credits do not expire while your account remains active.
• Credits are non-transferable between workspaces.
• Purchases are activated once payment clears; bank-transfer orders remain in pending state until funds are received.

We currently accept bank transfer. Card, PayPal and Stripe rails are shown as “coming soon” and are not active. Bank details are emailed after you place a bank-transfer order; your credits are provisioned once we receive the funds.

You are responsible for any taxes, duties or bank fees applicable in your jurisdiction.

Your use of the Services is also governed by our Acceptable Use Policy. Violations may result in suspension or termination without refund.

You retain ownership of data you upload (prospect lists, copy, brand assets). You grant Bynder AI a limited, worldwide licence to host, process and display that content solely to operate the Services for you.

You represent that you have the right to upload the content and to contact the prospects you load into Bynder AI, in accordance with applicable anti-spam laws (CAN-SPAM, CASL, GDPR, ePrivacy, etc.).

The Services, including software, models, documentation and trademarks, are owned by Bynder B.V. and its licensors. No rights are granted except the limited licence to use the Services during your active subscription to credits.

The Services are provided “as is” and “as available”without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. AI-generated output may contain inaccuracies; you are responsible for reviewing it before sending.

To the maximum extent permitted by law, Bynder AI will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenues. Our aggregate liability under these Terms is capped at the amount you paid to Bynder AI in the 12 months preceding the claim.

You may close your account at any time by emailing [email protected]. We may suspend or terminate access for material breach, misuse, non-payment or when required by law.

Unused credits at termination are handled per our Refund Policy.

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules. Any dispute will be resolved in the state and federal courts located in Wilmington, Delaware, unless mandatory local law provides otherwise.

We may update these Terms. Material changes take effect 14 days after we notify you. Continued use of the Services after the effective date constitutes acceptance.
